By accessing and using the HumanDISC platform ("Service"), you ("User") agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

2. Description of Service

HumanDISC provides an AI-powered DISC personality assessment platform that enables organizations to evaluate candidates and team members through behavioral assessments, report generation, and analytics.

3. User Accounts

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your credentials
  • You are responsible for all activities under your account
  • You must immediately notify us of unauthorized use
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Credit-Based Pricing

  • Assessment credits are purchased in advance and are non-refundable once used
  • Credits do not expire while your account is active
  • Prices are subject to change; existing credits are not affected
  • All transactions are final

5. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Share or resell assessment content, reports, or algorithms
  • Use automated scripts or bots to access the Service
  • Interfere with the integrity or performance of the Service
  • Use results for discriminatory practices prohibited by law

6. Intellectual Property

All content, features, design, algorithms, and functionality of the Service are the exclusive property of HumanDISC and are protected by intellectual property laws.

7. Assessment Results

  • Results are generated by AI and should be one factor among many in decision-making
  • Results are not a substitute for professional psychological evaluation
  • HumanDISC does not guarantee accuracy or suitability for any particular purpose
  • Organizations are solely responsible for how they use assessment data

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HUMANDISC, ITS SOFTWARE DEVELOPERS, TECHNOLOGY PROVIDERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES.

THE SOFTWARE DEVELOPERS AND TECHNOLOGY PROVIDERS WHO BUILT AND MAINTAIN THIS PLATFORM SHALL HAVE ABSOLUTELY NO LIABILITY WHATSOEVER TO ANY USER, ORGANIZATION, CANDIDATE, OR THIRD PARTY FOR ANY CLAIMS, DAMAGES, LOSSES, COSTS, OR EXPENSES OF ANY NATURE. THIS EXCLUSION IS ABSOLUTE AND APPLIES WITHOUT EXCEPTION.

10. Indemnification

You agree to indemnify, defend, and hold harmless HumanDISC, its developers, officers, directors, employees, and agents from all claims, liabilities, damages, losses, costs, and expenses arising from your use of the Service.

11. Governing Law

These Terms shall be governed by the laws of the applicable jurisdiction, without regard to conflict of law principles.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use constitutes acceptance.

13. Severability

If any provision is held invalid, the remaining provisions continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HumanDISC.
